In consolidated cases, Defendants-Appellants Adan Molina, Fidencio Verdin-Garcia, and Miguel Romero appealed denials of their respective motions for sentence reduction. Defendants relied upon U.S.S.G. Amendments 782 & 788 which retroactively lowered the base offense levels for many drug quantities listed in the Sentencing Guidelines. On appeal, defendants sought reversal of these denials on the basis that the district courts erred by failing to address their material, nonfrivolous arguments.
