Ghanian native and citizen, petitioner Joachim Addo appealed when his application for asylum was denied by an immigration judge and the Board of Immigration Appeals. Petitioner was the son of the chief of the Challa tribe. For several years the Challa have been in a land dispute with another tribe, the Atwode. The Atwode tribe was larger than the Challa, but the Challa controlled more land in the Nkwanta district, and in the past they often leased land to the Atwode. Starting in 2005 the Atwode began violating the lease terms and customs. Petitioner’s father instructed the Challa to stop leasing land to the Atwode, and he took the Atwode to court over the land disputes, winning every case. The Atwode responded with violence against the Challa and vowed to eliminate Petitioner’s father and family. This led to several violent incidents perpetrated by the Atwode against Petitioner and other members of his family. Shortly after these attacks, Petitioner and his father agreed that, for his own safety, Petitioner would relinquish his position as heir-apparent to the Challa chiefdom and would move from Nkwanta to Accra, the capital of Ghana. But this did not stop the Atwode, and harassment continued. In January 2017 Petitioner entered the United States. He expressed a fear of returning to Ghana and was granted a credible-fear interview. An asylum officer determined that Petitioner was credible and referred his case to adjudication. At a hearing in June 2017 the IJ determined that Petitioner was removable. Petitioner indicated, however, that he wished to apply for asylum, so the IJ scheduled a hearing to consider the asylum claim. Petitioner filed an application for asylum, withholding of removal, and protection under the Convention Against Torture. In the briefs on his petition for review by the Tenth Circuit Court of Appeals, Petitioner challenged the denial of asylum and withholding of removal, arguing that substantial evidence did not support the BIA’s determination that he could successfully avoid future persecution by relocating within Ghana. The Court agreed with Petitioner that the decision on his ability to safely relocate was unsupported by substantial evidence. The petition was granted and the matter remanded to the BIA for further proceedings. View "Addo v. Barr" on Justia Law

Eseos Igiebor, a citizen and native of Nigeria, entered the United States as a visitor in 1998. He became a lawful permanent resident (“LPR”) in 2004. In 2014, he pleaded guilty to: (1) aggravated identity theft; and (2) conspiracy to commit wire fraud, mail fraud, and bank fraud. He was sentenced to ninety-six months’ imprisonment and ordered to pay restitution. The Department of Homeland Security (“DHS”) initiated removal proceedings against Igiebor in 2018. Igiebor conceded removability, but sought deferral of removal pursuant to the Convention Against Torture (“CAT”). He asserted that due to his status as a homosexual, he would be tortured if removed to Nigeria. An immigration judge (“IJ”) concluded Igiebor’s testimony was not credible and found Igiebor failed to show it was more likely than not he would be tortured if returned to Nigeria. The Bureau of Immigration Appeals (“BIA”) determined the IJ did not commit clear error in finding Igiebor not credible and, given that adverse credibility determination, the IJ correctly found Igiebor did not carry his burden of proving it was more likely than not he would be tortured if returned to Nigeria. Igiebor petitioned the Tenth Circuit for review, challenging several aspects of the BIA’s decision. After review, the Tenth Circuit concluded Igiebor failed to identify any legal or factual error on the part of the BIA. Thus, the court denied Igiebor’s petition for review. View "Igiebor v. In this 42 U.S.C. 1983 action, Plaintiffs, three individuals who protested against abortion, challenged Norman, Oklahoma’s disturbing-the-peace ordinance, on its face and as the City has applied it to them. The specific issue presented in this interlocutory appeal was whether the district court abused its discretion in refusing to enjoin the City from enforcing the ordinance against Plaintiffs during this litigation. The Tenth Circuit concluded the district court did not abuse its discretion in denying Plaintiffs’ request for a preliminary injunction because they failed to show that they were substantially likely to succeed on the merits of their claims. The issue this case presented for the Tenth Circuit's review centered on whether a father's adopted child could qualify as his "legitimate" child for the purposes of section 1010(b)(1)(C) of the Immigration and Nationality Act when the child was not his biological child. Mr. Schreiber and his wife were U.S. citizens living in Kansas. In 2012, Mrs. Schreiber's niece moved from her native South Korea to Kansas to live with the Schriebers and attend high school. In 2014, the Schreibers adopted the niece under Kansas law with the consent of the child's parents. Kansas issued the child a new birth certificate listing the Schreibers as her parents. In 2015, Mr. Schreiber filed a petition to have his adopted child classified as his "child" for the purposes of the Act. The Board of Immigration Appeals determined legitimization only applied to a parent's biological children. The Tenth Circuit concluded the BIA correctly interpreted the Act's plain meaning, and thus, did not err in ruling that a parent's non-biological child could not be his "legitimized" child within the meaning of the Act. Furthermore, the Court concluded the district court properly declined to review Mr. Schreiber's "late-blooming" gender-discrimination challenge to the BIA's final agency action. View "Schreiber v. CEW Properties, Inc. was a firearms dealer licensed by the U.S. Department of Justice, Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”). In 2017, the ATF conducted a compliance inspection of CEW. Inspectors found that CEW had failed to: (1) record properly the acquisition and disposition of firearms; (2) conduct background checks on transferees; and (3) complete correctly the ATF form that documents the transfer of a firearm. The inspection discovered hundreds of violations. ATF therefore issued a notice to revoke CEW’s license. CEW requested a hearing, stipulating to the violations but arguing they were not “willful.” Following the hearing, ATF issued a final notice of revocation. CEW sought judicial review in district court. The court found the violations to be willful and granted summary judgment for ATF. CEW contested the district court’s finding that its violations of the Gun Control Act were “willful.” Because there was no genuine dispute the evidence was sufficient for ATF to conclude that CEW willfully violated firearms regulations, the Tenth Circuit Court of Appeals affirmed. Plaintiff-appellant Terri Baker appealed the dismissal of this putative class action for lack of standing. She sued on behalf of herself and her son, S.F.B., to challenge Kansas laws and school district policies that: (1) required children to be vaccinated to attend school and participate in child care programs; and (2) provided a religious exemption from these requirements. She claimed these immunization laws and policies violated various federal and state constitutional provisions and statutes. Baker argued she and S.F.B. had standing because the immunization requirements and religious exemptions injured them in two ways: (1) the District misapplied Kansas law when it granted a religious exemption for S.F.B. to attend preschool despite being unvaccinated - her fear that the District would revoke S.F.B.'s religious exemption was an injury in fact that established standing; and (2) Baker "would like the option" of placing S.F.B. in a non-accredited private school (i.e., home school), school programs, or licensed child care - she contended Kansas law inhibited her from exercising these options and caused an injury in fact because she would be unable to secure a religious exemption for S.F.B. if she tried. After a boiler exploded at a refinery, the Occupational Safety and Health Administration (OSHA) cited the refinery’s owner, Wynnewood Refining Co., LLC, for violating 29 C.F.R. section 1910.119, which set forth requirements for the management of highly hazardous chemicals. The Occupational Safety and Health Review Commission (the Commission) upheld the violations, noting that the refinery had previously violated section 1910.119, but the prior violations occurred before Wynnewood LLC owned the refinery, and therefore occurred under a different employer. Accordingly, the Commission did not classify the violations as “repeat[] violations” under 29 U.S.C. 666(a), which permitted increased penalties for “employer[s] who willfully or repeatedly violate[]” the regulation. Wynnewood appealed the Commission’s order, arguing that section 1910.119 did not apply to the boiler that exploded. The Tenth Circuit found section 1910.119’s plain text unambiguously applied to the boiler, and affirmed that portion of the Commission’s order upholding the violations. The U.S. Secretary of Labor also appealed the Commission's order, arguing the Commission erred by failing to characterize the violations as repeat violations. To this, the Tenth Circuit agreed Wynnewood was not the same employer as the refinery's previous owner, thus affirming that portion of the Commission's order relating to the repeat violations. The Appellants objected to the IRS’s attempts to collect and audit information about their marijuana-related business practices, arguing: (1) the IRS investigation was quasi-criminal, exceeded the Agency’s authority, and was being conducted for an illegitimate purpose; (2) even if the investigation had a legitimate purpose, the information sought was irrelevant; and (3) the investigation was in bad faith and constituted an abuse of process because (a) the IRS may share the information collected with federal law enforcement agents, (b) the IRS summonses are overly broad and require the creation of new reports, (c) the dispensaries had a reasonable expectation of privacy in the data they tender to state regulatory authorities, and (d) those state authorities could not provide the requested information without violating Colorado law. The Appellants further contended the district court applied the wrong standard of review when it denied motions to quash and granted motions to enforce the summonses. Relying on the reasoning outlined in Standing Akimbo, LLC v. United States, 955 F.3d 1146, 1150–69 (10th Cir. 2020), the Tenth Circuit rejected Appellants' arguments and affirmed the district court's rulings in favor of the IRS. View "Speidell v. Pretrial detainee Thomas Pratt exhibited alcohol withdrawal symptoms while in a county jail. Healthcare providers diagnosed and treated Pratt’s symptoms, but their course of treatment proved ineffective. Plaintiff Faye Strain, as Pratt’s guardian, sued. "Disagreement about course of treatment or mere negligence in administering treatment do not amount to a constitutional violation." To state a claim for deliberate indifference, a plaintiff must allege that an official acted (or failed to act) in an objectively unreasonable manner and with subjective awareness of the risk. "Indeed, the word deliberate makes a subjective component inherent in the claim." The Tenth Circuit concluded Plaintiff's allegations did not rise to the "high level" of deliberate indifference, and affirmed the district court's dismissal of Plaintiff's federal claims (in addition to the court's decision not to exercise supplemental jurisdiction over Plaintiff's remaining state law claims). The Pueblos of Jemez, Santa Ana, and Zia resided along the Jemez River at a time when their lands passed from Spanish to Mexican sovereignty, and finally to the United States. In 1983, the United States initiated a water-rights adjudication for the Jemez River Basin, claiming water rights on behalf of the Pueblos. The issue this case presented for the Tenth Circuit's review centered on whether the Pueblos' aboriginal water rights were extinguished by the imposition of Spanish authority "without any affirmative adverse act." No matter the method used, the sovereign’s intent to extinguish must be clear and unambiguous; “an extinguishment cannot be lightly implied in view of the avowed solicitude of the Federal Government for the welfare of its Indian wards.” Moreover, “if there is doubt whether aboriginal title has been validly extinguished by the United States, any ‘doubtful expressions, instead of being resolved in favor of the United States, are to be resolved in favor of’ the Indians.” The Tenth Circuit reversed the district court, finding that while "All conquering sovereigns possess authority over their land and resources ... not until the sovereign exercises this authority through clear and adverse affirmative action may it extinguish aboriginal rights."
