Sinclair Wyoming Refining Company petitioned the Tenth Circuit Court of Appeals under the Clean Air Act and the Administrative Procedure Act to challenge an email from an Environmental Protection Agency (“EPA”) official denying the return of its Renewable Identification Numbers (“RINs”) that it had deposited with EPA when it was not exempted from the Renewable Fuel Standard program for the year 2018. congressional mandate to compensate the Wyandotte Tribe for its loss of millions of acres in the Ohio River Valley morphed into a thirty-year dispute over ten acres in a Wichita, Kansas suburb. In 1992, eight years after Congress’s enacted remedy, the Tribe used $25,000 of that compensation to buy a ten-acre lot in Kansas called the Park City Parcel. The next year, the Tribe applied for trust status on the Park City Parcel under Congress’s 1984 enactment, but the Secretary of the Interior denied the application. The Tribe tried again in 2008, reapplying for trust status on the Park City Parcel to set up gaming operations. Since then, the State of Kansas opposed the Tribe’s efforts to conduct gaming on the Parcel. The State disputed the Tribe’s claim that its purchase came from the allocated $100,000 in congressional funds. And the State argued that no exception to the Indian Gaming Regulatory Act (IGRA) authorized the Tribe to operate gaming on the lot. In 2020, the Secretary rejected the State’s arguments, approving the Tribe’s trust application and ruling that the Tribe could conduct gaming operations on the Park City Parcel. The district court agreed. And so did the Tenth Circuit. The Court affirmed the ruling that the Secretary was statutorily bound to take the Park City Parcel into trust and to allow a gaming operation there under IGRA’s settlement-of-a-land-claim exception. Plaintiff-appellant Justin Hooper and the City of Tulsa disputed whether the Curtis Act, 30 Stat. 495 (1898), granted Tulsa jurisdiction over municipal violations committed by all Tulsa’s inhabitants, including Indians, in Indian country. Tulsa issued a traffic citation to Hooper, an Indian and member of the Choctaw Nation, and he paid a $150 fine for the ticket in Tulsa’s Municipal Criminal Court. Following the U.S. Supreme Court’s decision in McGirt v. Oklahoma, Hooper filed an application for post-conviction relief, arguing the municipal court lacked jurisdiction over his offense because it was a crime committed by an Indian in Indian country. Tulsa countered that it had jurisdiction over municipal violations committed by its Indian inhabitants stemming from Section 14 of the Curtis Act. The municipal court agreed with Tulsa and denied Hooper’s application. Hooper then sought relief in federal court—filing a complaint: (1) appealing the denial of his application for post-conviction relief; and (2) seeking a declaratory judgment that Section 14 was inapplicable to Tulsa today. Tulsa moved to dismiss. The district court granted the motion to dismiss Hooper’s declaratory judgment claim, agreeing with Tulsa that Congress granted the city jurisdiction over municipal violations by all its inhabitants, including Indians, through Section 14. Based on this determination, the district court dismissed Hooper’s appeal of the municipal court’s denial of his petition for post-conviction relief as moot. Hooper appealed. The Tenth Circuit Court of Appeals reversed, finding that the federal district court erred in dismissing Hooper's declaratory judgment claim because even if the Curtis Act was never repealed, it was no longer applicable to Tulsa. The Court also agreed with Hooper that the district court erred in dismissing his appeal of the municipal court decision as moot based on its analysis of Section 14, but the Court determined the district court lacked jurisdiction over Hooper’s appeal from the municipal court. Petitioner Sarah Farum filed a frivolous asylum application. An immigration judge determined the application rendered her permanently ineligible for immigration benefits under the Immigration and Nationality Act. Farnum did not challenge the frivolousness finding made by the immigration judge, nor did she challenge she had proper notice of the consequences of filing a false application. She instead challenged the timing of when the frivolous-asylum bar was effective. In her view, the frivolous-application bar outlined in 8 U.S.C. § 1158(d)(6) could not be invoked in the same proceeding as a frivolousness finding was made, thus allowing an immigration court to consider other potential claims that might support a finding that the Attorney General should withhold her deportation. To this, the Tenth Circuit Court of Appeals disagreed: "Once an immigration judge or the Board of Immigration Appeals makes the required frivolousness finding, the statutory bar is effective." Plaintiff-appellant Sharhea Wise worked as a mail carrier for the United States Postal Service. When she got pregnant, she asked to avoid handling heavy items. The Postal Service agreed to provide help when items were too heavy, but Wise needed to tell someone when she needed help. On two occasions, Wise allegedly had to handle items that were too heavy. Both times, she blamed the Postal Service for failing to accommodate her need for help. The Postal Service argued in response that Wise hadn’t asked for help. Days after Wise allegedly had to handle the heavy items, she walked off the job and the Postal Service fired her. Wise claimed retaliation, attributing the firing to her requests for help. The Postal Service denied retaliation, explaining that it had fired Wise because she walked off the job. Wise characterized this explanation as pretextual. The district court granted summary judgment to the Postal Service, and Wise challenged the rulings. The Tenth Circuit agreed with her challenge on the failure-to-accommodate claim. "On this claim, a reasonable factfinder could find that the Postal Service had failed to accommodate Ms. Wise’s need to avoid handling heavy items." But the Court agreed with the grant of summary judgment on the retaliation claim because: (1) the Postal Service presented a neutral, nonretaliatory explanation for the firing; and (2) Wise lacked evidence of pretext. Plaintiffs Citizens for Constitutional Integrity and Southwest Advocates, Inc. appealed the denial of their motion for temporary relief by the United States District Court for the District of Colorado. The Department of the Interior’s Office of Surface Mining Reclamation and Enforcement (the Office) granted a coal-mining permit for an expansion of the King II Mine (the Mine) in the Dunn Ranch Area of La Plata County, Colorado. Plaintiffs sought to enjoin mining under the expansion and ultimately vacate the permit. They alleged the Office conducted flawed assessments of the probable hydrologic impacts of the expansion, contrary to the requirements of the Surface Mining Control and Reclamation Act (the SMCRA or the Act). As authority for their motion, they invoked the Act’s citizen-suit provision, or alternatively, the Administrative Procedure Act (the APA). The Tenth Circuit Court of Appeals concluded Plaintiffs were not entitled to temporary relief because their claims under the SMCRA and the APA were not likely to succeed on the merits. In 2019, the United States Forest Service (“FS”) issued a Record of Decision (“ROD”) authorizing livestock grazing for 10 years on land in the Upper Green River Area Rangeland (“UGRA”) in Wyoming. Two sets of petitioners-appellants, the Center for Biological Diversity and Sierra Club (collectively, “CBD”) and Western Watersheds Project, Alliance for Wile Rockies and Yellowstone to Unitas Connection (collectively “WWP”) challenged the UGRA Project under the Endangered Species Act (“ESA”), the National Forest Management Act (“NFMA”), and the Administrative Procedures Act. The Tenth Circuit Court of Appeals concluded: (1) the Fish and Wildlife Service’s failures in the Biological Opinion to consider certain impacts the UGRA would have on female grizzly bears was arbitrary and capricious, but that the Opinion’s reliance on certain conservation measures was not; and (2) the Forest Service’s reliance on the Fish and Wildlife Service’s Biological Opinion was arbitrary and capricious. As to WWP’s NFMA claims, the Court determined the ROD’s failure to consider the adequacy of forage and cover for migratory birds in the Project area was arbitrary and capricious. Plaintiff Agnes Mukantagara, and her son, Plaintiff Ebenezer Shyaka, challenged an unfavorable United States Citizenship and Immigration Services (“USCIS”) decision on refugee status. Meanwhile, the government began separate removal proceedings. Plaintiffs filed this suit in the United States District Court for the District of Utah seeking judicial review of the termination of their refugee status. Defendants moved to dismiss, contending that the district court lacked subject matter jurisdiction because the agency action was not final and because of the jurisdiction-stripping provisions of the Immigration and Nationality Act. In the district court’s view, the regulation implementing the Immigration and Nationality Act’s provision allowing for the termination of refugee status, 8 C.F.R § 207.9, constitutes a triggering event that “arises from” an action taken to remove an alien. The district court said Plaintiffs’ claims fell within the scope of 8 U.S.C. § 1252(b)(9) because they challenged the decision “to seek removal.” The district court dismissed the action, concluding that it lacked jurisdiction. But the Tenth Circuit Court of Appeals determined the district court read the statute too expansively. “Congress did not intend the zipper clause 'to cut off claims that have a tangential relationship with pending removal proceedings.' ... the regulation strips USCIS’s discretion whether it should take action to remove an alien under the circumstances.” USCIS’s decision “is not a decision to ‘commence proceedings,’ much less to ‘adjudicate’ a case or ‘execute’ a removal order.” View "Mukantagara, et al. v. Appellant Audubon of Kansas (Audubon) was frustrated with federal bureaucracy: the United States Fish and Wildlife Service (the Service) knew for decades that junior water-rights-holders were impairing its senior water right in Quivira Wildlife Refuge (the Refuge), threatening the endangered species there. Despite years of study and negotiation between the Service, state agencies, and Kansas water districts, the Refuge water right remained impaired. Audubon filed this lawsuit seeking to force the Service to protect the Refuge water right. But in 2023, the Service did act by requesting full administration of the Refuge water right, which was a remedy Audubon sought for its failure-to-act claim. For its claims of unlawful agency action, Audubon also sought to set aside an agreement between the Service and a water district. The Tenth Circuit determined all material terms of this agreement expired. The Service argued Audubon’s claims were moot; Audubon countered that its claims weren't moot or that a mootness exception should apply. To this, the Tenth Circuit concluded Audubon’s claim of unlawful agency action under 5 U.S.C. § 706(2) was moot, and that claim was dismissed for lack of jurisdiction. As for Audubon’s claim of agency inaction under § 706(1), the Court found the mootness exception of “capable of repetition but evading review” applied, but the Court lacked jurisdiction under the Administrative Procedure Act. Middle schooler A.K. struggled with suicidal ideation for many years and attempted suicide numerous times, resulting in frequent emergency room visits and in-patient hospitalizations. A.K.’s physicians strongly recommended she enroll in a residential treatment facility to build the skills necessary to stabilize. Despite these recommendations and extensive evidence in the medical record, United Behavioral Health (“United”) denied coverage for A.K.’s stay at a residential treatment facility beyond an initial three month period. Her parents appealed United’s denial numerous times, requesting further clarification, and providing extensive medical evidence, yet United only replied with conclusory statements that did not address the evidence provided. As a result, A.K.’s parents brought this lawsuit contending United violated its fiduciary duties by failing to provide a “full and fair review” of their claim for medical benefits. Both sides moved for summary judgment, and the district court ruled against United. The issue this case presented for the Tenth Circuit's review was whether United arbitrarily and capriciously denied A.K. medical benefits and whether the district court abused its discretion in awarding A.K. benefits rather than remanding to United for further review. The Court ultimately concluded United did act arbitrarily and capriciously in not adequately engaging with the opinions of A.K.’s physicians and in not providing its reasoning for denials to A.K.’s parents.
